User Agreement

These terms explain our respective rights and responsibilities when you use your ShepShak account to share and sell photos.

1. ShepShak and these terms

ShepShak services are provided by ShepShak Inc. and ShepShak Ltd. Contact: hello@shepshak.com.

ShepShak helps independent photographers present and digitally deliver photos taken for their customers through QR albums. The photographer is the seller. These terms do not create an employment relationship or guarantee income, and do not remove ShepShak’s legal responsibilities.

Services depend on availability in the relevant country and account eligibility. Changing the display language does not change your operating country, currency or legal obligations.

2. Your account and verification

Registration is free and there is no subscription fee. Provide accurate, current information belonging to you or a business you are authorised to represent, and protect your login details. You must have the authority and legal capacity required in your country to carry out your activities.

Selling and receiving payments may require identity, contact, business or activity documents and payment details appropriate to your country and account type. Submission alone is not approval. Requirements and application status appear in the relevant account area.

3. The free trial

Eligible users can create free QR albums after signing in and verifying their email. Business or bank verification is not required. During this pre-launch period, there is no total free-photo allowance limit; each upload can contain up to 12 photos. Free-use conditions may be revised at commercial launch.

A free album has no price, payment, sales earnings or referral bonus. It cannot later become a paid album. Do not bypass trial limits with additional accounts or other methods.

4. Photography, albums and customer choice

Obtain the subject’s agreement before taking photos and venue or organiser permission where required. Photographing children requires a parent’s or legal guardian’s permission. Upload only photos of the relevant customer that you are authorised to offer.

An album contains up to 12 photos. You set one per-photo price for a paid album. Customers open the QR in a web browser and choose their favourites without an account or app. They are not required to buy. Video sales are not offered.

5. Access and delivery

An album’s 24-hour access period starts with uploading; for a free trial, it starts when the upload is reserved. Customers must purchase and download within that period. A purchase does not restart the clock. Paid purchases deliver the original uploaded file.

When the period ends, access closes and photos are subsequently deleted through automatic cleanup. Copies already downloaded to your device remain yours. Albums are not permanent storage, and photographers cannot manually delete them. Anyone with the QR link can access the album, so share it carefully.

A purchased-content access email is an additional delivery channel; it does not extend the album deadline and is not a tax invoice.

6. Rights to use photos

The photographer grants the customer the right to download, keep, share and use purchased photos of themselves, subject to third parties’ legal rights.

Photographers may use customer photos only for taking, presenting through the platform and delivering those photos. Portfolio, social media, advertising and other uses outside these purposes are prohibited. The permission granted to ShepShak is also limited to hosting, previews, delivery and service security; it does not authorise advertising or portfolio use.

Buying a photo does not transfer copyright or the rights of other people shown in it. The buyer’s right to use the photo does not authorize resale or licensing to third parties.

7. Sales shares and payouts

For a successful paid sale, the photographer’s base share is 90% of the sale amount and ShepShak’s share is 10%. Customers see the total payable and currency before payment.

Any applicable tax, payment or currency-conversion deductions and how they are calculated are disclosed before the relevant transaction and recorded separately. A displayed balance does not mean money has reached a bank account. Payouts go to a verified payment account according to provider schedules, transaction status and applicable conditions.

8. Refunds, disputes and adjustments

For payment problems, duplicate charges, defective content or download issues, contact hello@shepshak.com with your order details. Failed or unverified payments do not unlock paid content. Cancellation, withdrawal, refund and payment disputes are assessed according to the transaction and applicable mandatory law.

Delivery or downloading alone does not remove legally protected rights, including rights concerning defects or delivery failures. Relevant sales and balance records are adjusted when a refund or chargeback is required. Each refund request is assessed on its circumstances; mandatory legal rights remain protected.

9. Business details and sales documents

For paid sales flows made available, ShepShak undertakes the process of issuing the sales document on the photographer’s behalf and delivering it electronically to the buyer, based on the photographer’s authorization and accurate information. We may use our own infrastructure or service providers; photographers are not expected to prepare invoices manually. This service becomes available in sales flows where the required document infrastructure and legal requirements have been completed.

Photographers are responsible for monitoring their tax position, filing required returns and paying taxes on their own income. This does not remove any statutory document, reporting or withholding duties of ShepShak or its providers. Any additional authorization required for document issuance is obtained before sales are activated. A payment receipt or photo access email is not, by itself, a tax invoice.

10. Safe and respectful use

Unauthorised photo sharing, false documents, misleading accounts, artificial sales, referral abuse, harassment and interference with system security are prohibited. Tell us if you notice an error or unauthorised use.

Content, accounts or transactions may be restricted as necessary for security, rights violations, payment disputes or legal obligations. Where legally permitted, reasons are provided and you can request a review through Contact. Restrictions do not remove legally protected rights.

You may request account closure at hello@shepshak.com. Closure does not extinguish outstanding orders, refunds, amounts due or statutory retention obligations.

11. Privacy and the assistant

The Privacy Policy explains what data is processed and why, service-provider sharing, retention and how to make a request. Accepting this agreement is not blanket consent for activities that require separate permission.

The assistant provides information and guidance and may make mistakes. Its replies do not constitute account approval, financial or legal advice, or a payment commitment. Submit sensitive account information through the relevant secure form, not through chat.

12. Service and legal rights

Maintenance, connectivity or provider issues may cause interruptions and delays. Uninterrupted access, particular earnings or permission to work in every country are not guaranteed.

Liability is determined by applicable law. These terms do not limit ShepShak’s responsibilities where the law prohibits such limits, or mandatory consumer rights. Access to competent courts, consumer dispute bodies and other legal remedies is preserved.

Free friend invitations

Inviting friends is free. You may share your invitation link and track people who register through it. This feature does not create a right to a sales share, commission, bonus or other earnings.

13. Updates and contact

The current text is available from your account area. Material changes affecting your rights or financial terms are communicated before they apply; separate acceptance is obtained where legally required. New terms do not apply retroactively to completed transactions.

For questions or requests, use Contact in the side menu or hello@shepshak.com. Transaction-specific sales, payment and country terms are also provided before the relevant transaction.
